NeuroInclusion Works Ltd Legal Basis for Using Your Personal Information

Under Article 6 of the UK GDPR, we require a lawful basis to process any personal data. The most applicable lawful bases we rely on include:

  • Consent. Explicit consent from individuals, such as trainees, to process their health data.
  • Contractual Necessity. When processing is necessary to fulfil a contract, such as connecting trainees to suitable employers based on their needs.
  • Legitimate Interests. When processing is necessary for legitimate business interests, such as ensuring trainees are in appropriate placements. These interests must always be balanced against individual rights and freedoms.

Special Category Data Conditions

Health data is considered special category data and requires additional safeguards under Article 9 of the UK GDPR. NeuroInclusion Works processes this data under the following conditions:

  • Explicit Consent. Trainees explicitly agree to the processing of their health data for specific purposes.
  • Employment or Social Protection Law. Processing is necessary to meet legal obligations, such as making reasonable adjustments for neurodivergent individuals.
  • Vital Interests. Processing may be necessary to protect someone’s vital interests in exceptional circumstances (e.g., emergencies).

Schedule 1 of the DPA 2018

We also adhere to additional conditions outlined in Schedule 1 of the DPA 2018, including:

  • Employment, Health, and Social Care Purposes
  • Facilitating trainee placements.
  • Ensuring access to additional support services.
  • Monitoring trainee well-being and progress.
  • Substantial Public Interest
  • Supporting statutory purposes, such as promoting inclusion and diversity in employment.

Our Safeguards for Health Data

To meet the higher level of protection required for health data, we have instituted the following measures:

  • Data Minimisation. We only collect the health information that is absolutely necessary to achieve our purpose and delete it as soon as it is no longer needed.
  • Access Controls. Health data is accessible only to team members whose roles require it.
  • Encryption. All health data is encrypted both during storage and transmission to prevent unauthorised access.
  • Policy Documentation. We maintain clear policies and procedures for handling health data, including processes for gaining consent and managing data subject rights.

Sharing Personal Information with Others

We only share personal information where absolutely necessary and in line with legal requirements:

  • Business Clients. To ensure trainees are placed in roles that suit their needs and capabilities.
  • Professional Bodies. For example, sharing information with the Department for Work and Pensions (DWP) to support Access to Work grant applications.
  • Service Providers. Trusted third-party providers who assist in delivering our services (e.g. training platforms or IT support), ensuring they comply with our privacy standards.
